Who you are contracting with

Tomorrow's Word is provided by WordSpark (“we”, “us”). By using the site or buying a word you are entering an agreement with WordSpark and you accept these terms. If you are using the service for an organisation, you confirm you may bind it; otherwise you confirm you are of legal age. If you do not agree, please stop using the service. Buying a word

Buying gives you one thing: the right to set the secret word for one specific day, plus a short sponsor line shown on that day. The price you pay is the price shown at the moment you reserve, and it is held for ten minutes while you pay. Nobody can outbid you once the price is held and paid.

Payments, billing and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax and cancellation mechanics are governed by Paddle's Buyer Terms. Refunds are covered by our Refund Policy, which gives you a 30-day money-back guarantee.

Words we allow

The word must be a real, common word in our list, safe for a general audience, and not already used. We check as you type, but we review every purchase before it runs. If we reject a word, we refund you in full and that day falls back to an editorial word.

Your sponsor line

Name up to 40 characters, an https link, and a message up to 140 characters. You grant us a limited licence to host and display that content in order to run the service, and you confirm you have the rights to it. No hate, harassment, adult content, scams, or impersonation. We may remove a sponsor line that breaks these rules.

Acceptable use

You must not use the service unlawfully; commit fraud, spam or impersonation; infringe anyone's intellectual property; or interfere with the service's security through malware, probing, scraping, automated play or attempts to circumvent technical limits.

Intellectual property

WordSpark owns, or licenses, the service and everything in it — the software, the word lists and rankings, the site design, the documentation and the branding. You receive a limited, non-exclusive, non-transferable right to use the service; nothing here transfers ownership. You may not copy, resell, redistribute or reverse engineer the service.

Service level and warranties

The game is provided as is. We do not guarantee that the service will be uninterrupted, timely or error-free, and to the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose. We may change the rules, the word list or the service at any time.

Suspension and termination

We may suspend or terminate your access to the service, in whole or in part, if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our content rules. Where it is reasonable to do so we will warn you first. A word already published stays in the archive unless we remove it for a rule breach.

Liability

To the extent permitted by law, our total liability arising out of the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss, including lost profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by our negligence, or anything else that cannot be limited by law.

General

You may not assign these terms without our consent; we may assign them as part of a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the seller's jurisdiction and disputes go to its courts.
